City Rejects Golf Nets... Again

Most in our neighborhood have followed closely the long-standing golf net issue between area HOAs, residents, and the City of Plano.  For those that have not, the short version is that a resident of another neighborhood bordering the Prestonwood Country Club erected a 50 foot net on his property line in an effort to prevent errant golf balls from striking his house or yard.  The net was constructed without approval of the governing HOA and without a permit from the city.  A heated dispute quickly ensued, including litigation, mediation, and a commitment by the City of Plano to propose an ordinance change that would address the homeowner concerns of safety and damage to property.  Over the course of the last year Plano officials have proposed two separate changes in zoning ordinances that would have permitted the legal construction of nets by either golf course operators or homeowners.  Both proposals were rejected by the Plano City Council, including provisions to classify these structures as "nets" and not fences.  Accordingly, no fence may be more than eight feet in height.

Based on the city's actions, current ordinances, and existing HOA CC&R's, our association will continue to prohibit the construction of golf nets or other fences greater than eight feet in height by our members.  As you know, all modifications or additions to your property require review and approval by our Architectural Review Committee. We regularly review and approve changes related to landscaping, additions, fences, retaining walls, roofs, and other structures and would be happy to speak with you about options and plans you have to enhance your home.
